A Federal Judge Elizabeth LaPorte (San Fransisco) has asked the NMFS to rethink there listing of Green Sturgeon as a fit canidate under the ESA. The Administration Backed Plan for The Klamath Basin just took a hit! They are sooner or later actually going to let some water down that ditch for the fish.
NMFS (under this administration) has chose not to pursue listing the Green Sturgeon as endangerred. The Judge showed them where in there reports it clearly stated that the Sturgeon face Extinction if they don't get more water and Habitat for spawning. I wonder who forgot to edit out that little bit of info from the report. (Must have been a draft).:rolleyes:

But you still have the problem of already having the introduced sucker in the upper basin listed as threatened. Seems like a judge is going to have to decide which fish is more important, the already listed sucker or the sturgeon. Looks like a lot of litigation is going to be needed to resolve this. Then there are the rancher/farmers in the upper basin who were promised cheap irrigation water from the dams with water rights already in their hands for this water. And we know how the average Joe non-fisher thinks about the "poor rancher/farmer" getting raked over by the regulators.
