The Supreme Court usually takes only cases involving constitution of the United States.
I don’t see the case here. For example when federal court in Alaska has rules against the administration against oil drilling around the famous Teshekpuk Lake ( and many more high profile cases were Bush Administration has broken the existing law, surprise……) in Northern Alaska the Interior Dep. didn’t even bother to appeal.
There is not even any guarantee that the Supreme Court will take the case and even if the take ( at least year ) Justice Kenedy who recently ruled against the administration on global warming may not side with Bush.
Let’s keep in mind that in January 2008 the brutal “winter” for environment will end  and Spring will come. How warm nobody knows……, but the new administration will most likely not declare war on environment and not to undermine the existing law like never before.
